To do so, you can use the link [+ NEW REPORT].<\/p>\n<p><\/p>\n<p><strong>DESTINATION.<\/strong><br \/>The channel is open to persons who are employed; self-employed; shareholders, partners and persons belonging to the administrative, management or supervisory body of a company, including non-executive members. Any person working for or under the supervision and direction of contractors, subcontractors and suppliers. Whistleblowers who communicate or publicly disclose information about infringements obtained in the context of a terminated employment or statutory relationship, volunteers, interns, workers in training periods regardless of whether they receive remuneration, as well as those whose employment relationship has not yet begun, in cases where the information about infringements has been obtained during the selection process or pre-contractual negotiations.   <br \/>This channel allows for the submission of communications in writing or verbally, or both.<\/p>\n<p><\/p>\n<p><strong>INFORMATION POLICY AND PROCEDURE.<\/strong><br \/>OXIPLANT has a policy that sets out the general principles regarding internal information systems and whistleblower protection. This good faith is an expression of civic behaviour and contrasts with other actions that, on the contrary, must be excluded from protection, such as the submission of false or distorted information, as well as information that has been obtained illegally. <\/p>\n<p><\/p>\n<p><strong>PROTECTION OF PERSONAL DATA.<\/strong><br \/>The processing of personal data resulting from the implementation of this Communications Channel shall be governed by the provisions of Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016, Organic Law 3\/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, Organic Law 7\/2021 of 26 May on the protection of personal data processed for the purposes of prevention, detection, investigation and prosecution of criminal offences and the enforcement of criminal penalties, and this title. Interested parties have access to all information relating to the processing of personal data related to the actions or omissions communicated through this Communications Channel.<\/p>\n<\/div><div data-size=\"auto\" class=\"tab-pane fade  \" id=\"ut_tab_69e92bc3eaf14\"> <strong>POLICY OF MANAGEMENT OF THE COMMUNICATIONS CHANNEL<\/strong><br \/>All employees and stakeholders of Oxiplant Centro de Transformaci\u00f3n del Acero S.L. must behave with integrity and comply with laws and internal regulations in their daily activities. Furthermore, they have a duty to cooperate in preventing anyone from acting improperly or dishonestly.<\/p>\n<p>Therefore, it is a duty of all employees, managers, collaborators, suppliers etc. report any suspected irregularity or act contrary to the law or the internal rules of those who have knowledge thereof.<\/p>\n<p>Only in this way will it be possible to verify any suspicion or doubt of irregularity and, where appropriate, take the necessary measures to remedy its consequences and prevent such irregularities from recurring in the future, thereby improving the professional, social and ethical environment and commitment to compliance with laws and regulations. Taking into account the provisions of Directive (EU) 2019\/1937 of 23 October 2019 on the effective protection of persons who report breaches of European Union law, as well as Law 2\/2023 of 20 February regulating the protection of persons who report regulatory breaches and the fight against corruption, which transposes the Directive into Spanish law, the company is launching a Communications Channel through which employees, managers and other stakeholders can communicate any information they may have, by any means, formal or otherwise, about the existence of a possible irregularity, act contrary to the law or internal regulations, including any irregularities relating to accounting matters or auditing issues. <\/p>\n<p>The management of the Communications Channel is governed by the principles of confidentiality of the data provided and the statements made, respect and sound reasoning; thus, any decision taken after receiving the information will be made in a reasoned and proportionate manner, taking into account the circumstances of the reported events, with full respect for the rights and due guarantees of the whistleblower and any affected persons, if applicable.<\/p>\n<p>Similarly, the presumption of innocence is guaranteed to all persons affected. Any person who reports an incident will receive the appropriate protection, and any action taken against them that could be construed as a threat, discrimination or retaliation will be punished. There is no specific format for reporting incidents through the Communications Channel, and reports can be made anonymously. It is advisable to provide a complete description of the reported incident, identify the persons allegedly affected or involved in it, if any, and provide specific details, dates, companies or third parties related to the incident or action described, all with a view to facilitating, where appropriate, the subsequent verification of the facts reported. PURPOSE.<\/strong><br \/>This procedure defines the system for establishing the Communications Channel provided by the organisation, in response to the content of Directive (EU) 2019\/1937. This text specifies guidelines aimed at establishing common rules to ensure the effective protection of persons who report breaches of European Union law. <\/p>\n<p>Similarly, it includes the content of Law 2\/2023, of 20 of February, regulating the protection of persons who report on regulatory violations and the fight against corruption.<\/p>\n<p>This procedure regulates the process necessary for the management, awareness and effectiveness of the channel, establishing channels for members of the organisation and third-party collaborators to report, in good faith and with reasonable evidence, any actions or omissions that pose risks or breaches of current legislation, guaranteeing protection against reprisals.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>02. DEFINITIONS.<\/strong><br \/><strong>Informant:<\/strong> A person who reports the existence of an incident or irregularity that contravenes the law or the organisation&#8217;s rules.<\/p>\n<p><strong>Reported:<\/strong> Person to whom the alleged commission of an irregularity is attributed.<\/p>\n<p><strong>Responsible for the System: <\/strong> Person appointed by the company for the approval and supervision of the procedure, ensuring the effectiveness of the communications channel.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>03. APPLICATION.<\/strong><\/p>\n<p><strong>3.1. Scope.<\/strong><br \/>The Communications Channel is applicable to all whistleblowers who work for the company and have obtained information about violations in a work or professional context, including: \u2014 Employees. \u2014 Shareholders, partners and members of administrative, management or supervisory bodies, including non-executive members. \u2014 Persons working under the supervision of contractors, subcontractors and suppliers. \u2014 Whistleblowers from terminated employment relationships, volunteers, interns and trainees. \u2014 Persons whose employment relationship has not yet begun when the information is obtained during recruitment processes.<\/p>\n<p><strong>3.2. Commitment of the company.<\/strong><br \/>The company shall ensure that the general operating principles of the communications channel are adequately publicised so that all interested parties are aware of them.<\/p>\n<p><strong>3.3. Responsible for the System.<\/strong> <br \/>The administrative body shall appoint the individual responsible for the system. Their appointment and dismissal must be notified to the Independent Whistleblower Protection Authority where applicable. <\/p>\n<p>The System Manager shall act independently and autonomously, being a senior manager who assumes these functions in addition to those inherent to their position.<\/p>\n<p><strong>3.4. Communication plan. <\/strong><br \/>Effective communication is essential for the implementation and sustainability of the channel. The communication plan includes the dissemination of:<br \/>\u2014 Policy of the system internal of information and defence of the informant. <br \/>\u2014 Regulation of the channel.<br \/>\u2014 Information about its operation and form of communication. <\/p>\n<p>&nbsp;<\/p>\n<p><strong>04. PROCESSING OF COMMUNICATIONS.<\/strong><\/p>\n<p><strong>4.1. Means enabled. <\/strong><br \/>Communications may be made:<br \/>\u2014 In writing, by post: Pol\u00edgono Industrial de Somonte, C\/ Mar\u00eda Gonz\u00e1lez \u2018La Pondala\u2019, 18, 33393 Gij\u00f3n, Asturias.<br \/>\u2014 Digitally, using the SESAME HR solution.<br \/>\u2014 Verbally or in person (informing the other party of the recording and data processing).<\/p>\n<p><strong>4.2. Processing of the information received. <\/strong><br \/>It is recommended to use the form &#8220;New Communication&#8221;. Once received, it will be acknowledged within a period of 7 days if it does not compromise confidentiality. <\/p>\n<p>The organisation shall archive the communication, guaranteeing secrecy and confidentiality, protecting the identity of both the complainant and the respondent.<\/p>\n<p><strong>Preliminary analysis<\/strong>: The person responsible for the system will assess whether the processing is appropriate. Communications that are unfounded or anonymous without sufficient data will be archived. <\/p>\n<p><strong>Fact checking<\/strong>: Other areas of the company or third parties may be required to support the investigation.<\/p>\n<p><strong>Resolution:<\/strong><br \/>\u2014 If there is no proven infringement: close the case. <br \/>\u2014 If there is a proven irregularity: transfer to Human Resources and\/or Legal Services.<\/p>\n<p>The person involved will be informed without revealing the identity of the informant. The maximum duration of the investigation shall be three months, extendable by a further 3 months in cases of complexity. <\/p>\n<p><strong>4.3. Record keeping.<\/strong><br \/>The company shall maintain a digital record of all communications and investigations, accessible only by judicial authority by means of a court order.<\/p>\n<p><strong>4.4. Processing of personal data . <\/strong><br \/>The processing shall be governed by the GDPR, the Organic Law 3\/2018 and the Organic Law 7\/2021.<\/p>\n<p>The identity of the informant will always remain confidential and may only be disclosed to judicial, prosecuting or administrative authorities in legal cases.<\/p>\n<p>The data will only be kept for as long as is strictly necessary. If no investigation is initiated within three months, the data will be deleted or anonymised. <\/p>\n<p>&nbsp;<\/p>\n<p><strong>05. PROTECTION FOR WHISTLEBLOWERS. <\/strong><br \/>The company shall guarantee protection to those who report or disclose breaches when: <br \/>\u2014 They have reasonable grounds to believe that the information is truthful. <br \/>\u2014 Act in good faith.<\/p>\n<p>Excluded are interpersonal conflicts or cases based on rumours or public information.<\/p>\n<p><strong>5.1. PROHIBITION OF RETALIATION.<\/strong><br \/>The company shall avoid any act of retaliation, whether direct or indirect. Acts that cause harm in the workplace or professionally due to the status of the whistleblower are considered retaliation, including those occurring up to two years after the conclusion of the proceedings. <\/div><div data-size=\"auto\" class=\"tab-pane fade  \" id=\"ut_tab_69e92bc3eafbb\"> The processing of personal data resulting from the implementation of this Communications Channel shall be governed by the provisions of Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016, Organic Law 3\/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, Organic Law 7\/2021 of 26 May on the protection of personal data processed for the purposes of prevention, detection, investigation and prosecution of criminal offences and the execution of criminal penalties, and this title.<\/p>\n<p>Personal data that is not clearly relevant to the processing of specific information will not be collected, and if collected accidentally, it will be deleted without undue delay.<\/p>\n<p>The attached table provides the information referred to in Article 13 of Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 and Article 11 of Organic Law 3\/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>RESPONSIBLE<\/strong> Oxiplant Centre for Transformation of Steel Ltd.<\/p>\n<p><strong>PURPOSE INTENDED<\/strong><br \/>Management of the Channel of Communications implemented by the company<\/p>\n<p><strong>D.P.O. (DATA PROTECTION OFFICER)<\/strong><br \/>Excell Compliance S.L. \u2013 Ignacio Adaro Garc\u00eda<\/p>\n<p><strong>LEGITIMACY<\/strong><br \/>The processing of personal data, in the case of internal communications, is understood to be lawful by virtue of the provisions of Articles 6.1.c) of Regulation (EU) 2016\/679, 8 of Organic Law 3\/2018 and 11 of Organic Law 7\/2021, when it is mandatory to have an internal information system in accordance with Articles 10 and 13 of the law.<\/p>\n<p>If the person affected exercises their right of opposition, it shall be presumed, unless there is evidence to the contrary, that there are legitimate compelling reasons that justify the processing.<\/p>\n<p><strong>INTERNATIONAL DATA TRANSFER<\/strong><br \/>No international data transfer will be made.<\/p>\n<p><strong>RECIPIENTS OF DATA TRANSFERS<\/strong><br \/>Access will be limited exclusively to:<br \/>\u2014 The System Manager and those who manage it directly.<br \/>\u2014 The head of human resources or competent body, if disciplinary measures are required.<br \/>\u2014 Competent authorities for corrective measures, complaints, or disciplinary or criminal proceedings.<\/p>\n<p><strong>RIGHTS<\/strong><br \/>\u2014 Right of access to personal data.<br \/>\u2014 Right of rectification or erasure.<br \/>\u2014 Right to restriction of processing.<br \/>\u2014 Right to object to processing.<br \/>\u2014 Right to data portability.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>ADDITIONAL INFORMATION<\/strong><br \/>Personal data that is not necessary for investigating the reported actions or omissions will not be processed. Unnecessary data will be deleted immediately.<\/p>\n<p>If data belonging to special categories is received, it will be deleted immediately without being recorded or processed.<\/p>\n<p>The data will only be kept for as long as is necessary to decide whether to initiate an investigation.<\/p>\n<p>If the information or part of it is not accurate, it will be deleted immediately, unless it may constitute a criminal offence.<\/p>\n<p>After three months without initiating proceedings, the data must be deleted, unless it is necessary to retain evidence of the functioning of the system.
